About these terms

These terms and conditions ("Terms") form an agreement between you and Smart Things Research SRL, a company based in Bucharest, Romania, which operates DermatoGPT ("DermatoGPT", "we", "us"). They apply to our website at dermatogpt.app, the DermatoGPT app and related services (together, the "Service").

By using the Service, you agree to these Terms and to our privacy policy. If you do not agree, please do not use the Service.

Medical disclaimer

The Service provides general information and guidance about skin concerns based on the photos and answers you provide. The possible causes, care options and next steps it suggests:

• are not a diagnosis, and may be incomplete or wrong;
• do not replace advice, diagnosis or treatment from a doctor, dermatologist, pharmacist or other qualified healthcare professional;
• do not create a doctor–patient relationship between you and DermatoGPT or anyone working with us.

Always seek the advice of a qualified healthcare professional about any medical condition. Never ignore professional advice, or delay seeking it, because of something you read in the Service. Seek medical help promptly if a concern is getting worse, spreading quickly, painful, bleeding, changing in appearance, or accompanied by fever or feeling unwell.

Before using any over-the-counter product mentioned in the Service, read the label and check with a pharmacist or doctor, especially if you are pregnant, breastfeeding, taking other medicines, or treating a child.

The Service

DermatoGPT lets you upload a photo of a skin concern, answer questions about it, and receive AI-generated guidance on possible causes, self-care options and whether to see a clinician. We may add, change or remove features over time. We will try to give you notice of changes that significantly affect you.

The quality of the guidance depends on the quality of the photo and the accuracy of your answers. The Service may not recognise rare conditions, and its performance may vary between people and situations.

Eligibility and accounts

You must be at least 18 years old to use the Service. A parent or legal guardian may use the Service to ask about a concern affecting their child, and is responsible for that use.

You are responsible for keeping your account details secure and for all activity under your account. Tell us straight away at contact@dermatogpt.app if you think someone else has accessed your account.

Acceptable use

When using the Service, you agree not to:

• upload photos of another person without their permission, or of a child unless you are their parent or legal guardian;
• upload content that is unlawful, sexually explicit or unrelated to a skin concern;
• use the Service to give medical advice to others, or present its output as a professional diagnosis;
• copy, scrape, reverse engineer or attempt to extract our models, data or source code;
• interfere with the security or operation of the Service, or use it to build a competing product;
• use the Service in any way that breaks the law.

Your content

You keep ownership of the photos and information you upload ("Your Content"). You give us a limited, non-exclusive licence to store and process Your Content only as needed to provide the Service to you, keep it safe, and meet our legal obligations.

We will only use Your Content to improve our models if you explicitly opt in. You can withdraw that permission, and delete Your Content, at any time. See our privacy policy for details.

Plans and payments

Basic assessments are free. We plan to offer an optional Premium subscription with additional features. If you subscribe:

• prices, including any applicable VAT, will be shown before you pay;
• your subscription renews automatically each billing period until you cancel;
• you can cancel at any time, and you will keep access until the end of the period you have paid for;
• as a consumer in the EU, you have 14 days from purchase to withdraw and receive a refund. If you ask us to start providing Premium features immediately, you agree that your refund may be reduced in proportion to the service already provided.

We will give you at least 30 days' notice of any price change, and you can cancel before it takes effect.

Early access and beta features

Some features are offered as early access or beta. They may be incomplete, change without notice, or be withdrawn. We welcome your feedback, and you agree that we may use any suggestions you give us to improve the Service without owing you anything.

Intellectual property

The Service, including its software, models, design, text, graphics and the DermatoGPT name and logo, belongs to DermatoGPT or our licensors and is protected by intellectual property laws. We give you a personal, non-transferable right to use the Service for your own non-commercial purposes, in line with these Terms.

Liability

We work hard to make DermatoGPT accurate, safe and available, but we provide the Service "as is" and cannot promise that it will always be error-free, uninterrupted or suitable for your particular situation.

To the extent permitted by law, we are not responsible for losses that result from relying on the Service instead of seeking professional medical advice, or for losses that were not reasonably foreseeable. Our total liability to you in connection with the Service in any 12-month period is limited to the amount you paid us in that period, or €100 if greater.

Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot be limited under applicable law. If you are a consumer, nothing in these Terms affects your statutory rights.

Ending your use of the Service

You can stop using the Service and delete your account at any time. We may suspend or close your account if you seriously or repeatedly break these Terms, or if we need to for legal or safety reasons. Where reasonable, we will tell you why and give you a chance to download your data first.

Governing law and disputes

These Terms are governed by Romanian law. If you are a consumer living in another EU country, you also keep the protection of the mandatory consumer laws of your country, and you may bring proceedings in your local courts.

If you have a complaint, please contact us first at contact@dermatogpt.app. Most issues can be resolved quickly and informally.

Changes to these Terms

We may update these Terms from time to time. We will post the new version on this page and update the "last updated" date. If a change materially affects you, we will tell you by email or in the app at least 30 days before it takes effect. If you continue to use the Service after that, you accept the updated Terms.
